What information is in place to address the privacy issues surrounding the collecting, referring and receiving of client information?
FACT - NSW Government agencies are bound by the Privacy and Personal Information Protection Act 1998. All organisations in NSW (including public sector and NGOs) are also bound by the Health Records and Information Privacy Act 2002 in relation to personal health information.
The HSNet Privacy Policy has been approved by the NSW Privacy Commissioner and all agencies must work within its framework as required by law.
Agencies and their staff must agree to abide by the privacy principles and sign an agreement prior to being eligible to use the eReferral tool.
Clients have the absolute right to refuse permission for one agency to send their personal information to another agency. There are very limited exceptions to this right, tightly regulated by law.
All clients also have the right to be provided with a printed, legible copy of a referral made by the agency on their behalf.
